These Terms of Service ("Terms") govern your use of Nightletter (the "Service"), operated by Lodestar Holdings LLC, a Wyoming limited liability company doing business as Nightletter ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.
You must be at least 18 years old and the parent or legal guardian of any child whose information you provide to use the Service. Nightletter is designed for use by adults on behalf of their children. Children do not create accounts, log in, or interact directly with the Service.
Nightletter generates personalized, AI-created bedtime stories and on-demand short stories for children, based on information provided by the subscribing parent or guardian, including but not limited to a child's name, preferred display name, interests, story world/companion preferences, and optional daily details ("Heartstrings") shared by the parent.
Stories are generated using artificial intelligence (currently Anthropic's Claude models) and are delivered via email and/or displayed within the Service's dashboard.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.
You retain ownership of the information you submit about your child, including Heartstrings and any other details you share. By submitting this information, you grant us a license to use it solely to generate stories and operate the Service for your account. We do not use your child's information to train AI models or share it with third parties for their own marketing purposes.
You are responsible for the accuracy and appropriateness of information you submit, and for ensuring you have the right to share any information you provide about your child.
Stories generated through the Service are made available to you for personal, non-commercial, family use — including reading, saving, and printing for your own household's use. We do not claim exclusive ownership that would prevent you from keeping, printing, or personally using stories generated for your family.
Because stories are generated using AI, we cannot guarantee that any story is entirely free of similarity to existing works, and we make no representation regarding the copyright status of AI-generated output beyond your license to personal use as described above.

Nightletter is not therapy, counseling, or a medical or psychological service. Stories generated through the Service are creative, narrative content intended for entertainment and connection between parent and child. They are not a substitute for professional mental health care, medical advice, or educational intervention.
We do not guarantee any emotional, developmental, behavioral, or educational outcome from use of the Service. Any anecdotes, testimonials, or descriptions of how stories have resonated with individual children are personal accounts, not representations of typical results or guaranteed effects for your child.
If you have concerns about your child's emotional or psychological wellbeing, please consult a qualified professional.
The Service relies on third-party providers, including but not limited to Anthropic (AI story generation), Stripe (payment processing), and Resend (email delivery). Your use of the Service is also subject to the applicable terms of these providers where relevant. We are not responsible for outages, errors, or issues originating from third-party services outside our control.
The Nightletter name, logo, branding, website, and underlying software are the property of Lodestar Holdings LLC and may not be copied, used, or reproduced without our written permission, except as expressly permitted by these Terms.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that story content will always meet your expectations.
To the fullest extent permitted by law, Lodestar Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Lodestar Holdings LLC from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.
We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or other reasonable cause. You may terminate your account at any time by cancelling your subscription and, if desired, requesting account deletion.
We may update these Terms from time to time. We will provide reasonable notice of material changes, such as by email or a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles, except where superseded by applicable federal law.
